Use of Metastatic Trial Search (MTS) is subject to these Terms of Use. By using this website you agree that you have read, understand, and accept our Terms & Conditions.
Metastatic Trial Search is a website that provides information about clinical trials and assists users in finding trials. The information we provide is educational and should not be used in place of a medical consultation with a professional healthcare provider.
Member Registration
An MTS Member is either a) a person ("User") who creates and manages MTS records that contain his/her medical history, or b) a person ("Navigator") who creates and manages MTS records that contain the medical history of others. If you choose to become a MTS Member, you will be asked to register a user name (email address) and password. As a registered user, you agree:
You are responsible for all usage or activity on your account. You must notify us of any suspected unauthorized use of your account, or any suspected breach of security, including loss, theft, or unauthorized disclosure of your password.
Copyright License and Trademark Notice
MTS technology and its content (such as articles, bulletin boards, software, calculators, directories, databases and editorial information) are the property of MTS, and are protected by copyright and other intellectual property laws.
Except as permitted by these Terms of Use, you agree not to modify, copy, rent, lease, loan, sell, distribute or create derivative works based on MTS, in whole or in part.
You may display and print contents from MTS for your own use only. In this case, permission to use documents from MTS is granted, provided that all copyright notices and other proprietary rights notices appear. Any other copying, modification, redistribution, publication or retransmission is strictly prohibited without our prior written consent.
You acknowledge that Metastatic Trial Search is a trademark of QuantumLeap Healthcare Collaborative, and that you may not use it without our prior written consent.
Legal Disclaimer
You agree that your use of MTS is at your sole risk and responsibility. MTS is provided on an "AS IS" basis without warranties of any kind, expressed or implied.
You agree that in no event shall MTS be liable for any incidental or consequential damages resulting from use of its website. That includes damages for loss of use, data or profits - whether or not you advise us of the possibility of such damages. That also includes damages arising from your use of any information.
Any material downloaded or obtained through the use of MTS is done at your own discretion and risk. In particular, MTS disclaims any responsibility for any damage to your computer system or loss of data resulting from the download of such material.
MTS makes no warranty that the results generated by a match will be free from error, or if used will ensure compliance with the relevant health information laws. Before relying on the website's results, you should carefully evaluate their accuracy and completeness for your purposes, and obtain appropriate expert advice.
Given these limitations, the results generated by the matching service will be approximate in nature.
We provide third-party links on MTS only as a convenience, and the inclusion of any link does not imply endorsement by us. Any hyperlink, association, connection or reference made by third party sites or any other commercial or non-commercial organizations to MTS is strictly prohibited without our prior written consent.
Confidentiality
If you become a MTS Member, we will generally store the data you enter into the web site for your own later use. You may access your data for up to six months from initial entry into the web site. After that time, we may, at our option, delete the data, unless you have updated it upon request.
Application of this Terms and Conditions
This Terms and Conditions applies only to our website, http://metastatictrialsearch.org. It does not apply to any website links we may provide on our site. Once you leave our site, we are not responsible for how other websites treat your privacy. Therefore, you should read the terms and conditions and privacy policy of each of the websites you visit after leaving MTS.
Changes
We may, from time to time, make changes to our Terms and Conditions and Privacy Policy. We will alert you to such changes by posting them on our website in a timely manner. Please check periodically to make sure you have read the most current terms and conditions and policy.
In the unlikely event that the change affects the way we handle MTS Members' personal information, we will ask you to agree to these changes by electronic consent. Minor changes to our Terms and Conditions or Privacy Policy that, in our judgment, do not affect the handling of your personal information will not require that we contact you beforehand, and will not require your authorization prior to continued use of your information.
In spite of conscientious efforts we make to prevent unauthorized parties from gaining access to the information you submit to us, we cannot guarantee that such access or tampering will never occur, or that the information submitted by you will be protected against loss, misuse, or alteration by third parties.
Applicable Law and Jurisdiction
These terms and conditions are governed by the laws of the State of California. You agree to submit to the exclusive jurisdiction of the courts of the State of California. You also agree that any claim or cause of action arising out of or related to use of the MTS website will be barred unless filed within one year after the claim or cause of action arises.
Use of MTS is subject to your agreement with these Terms of Use, which may be modified at any time without notice to you. You may use various services on MTS as an unregistered guest or as a MTS Member.
We reserve the right at any time to modify or discontinue, with or without notice, MTS or any of the services on the website.
Whether you use Metastatic Trial Search as a Guest or Member, we consider it our utmost responsibility to protect your privacy. We will never sell or share your personal health information without your explicit permission.
As a Guest, you can use Metastatic Trial Search (MTS) on a one-time basis; when you leave, we will no longer have access to your data. Members are MTS users who save their Health History to our secure servers. As a Member you can update your Health History. MTS Members have complete control over what is contained in their Health History and with whom it can be shared. MTS will never share your personal health information with any individual or organization without your explicit permission. By personal health information, we mean any information that is protected by the U.S. Government Medical Privacy Rule (HIPAA). This includes your name, email address, mailing address, telephone number, and date of birth. Although MTS is not explicitly covered by HIPAA, we adhere to its guidelines.
To help us learn more about the individuals who are using our service, MTS creates summary reports by combining non-identifiable data - such as tumor type - from your record with that of other patients. Our summary reports are for MTS use only and will not be shared with any individual or organization.
MTS Members can delete their personal Health History from MTS at any time. Your personal data will be removed from our system when you delete your profile.
Password-protected records: When you save your Health History for the first time, we will ask you to select a user name and password. From then on, only an individual with that user name and password can access your record.
MTS Access to User Health History: MTS staff do not have routine access to user Health Histories. Occasionally, however, MTS staff may need to access a user record. This will only occur if staff need to contact a user.
A "guest" is someone that uses the matching tool without saving his/her information under a user name and password. If you use MTS as a guest your personal health history will be deleted when you end your session.
Electronic Security: Our website follows the security guidelines of the United States Health Insurance Portability and Accountability Act of 1996 (HIPAA). All Metastatic Trial Search data is transmitted, stored, and processed in a secure environment.
Summary Data: Metastatic Trial Search pools non-identifiable information from Health History records (such as tumor type and treatment history) to create summary reports that we use to improve our service. Our summary reports do not contain data that could be traced back to you personally. We will not sell or share summary reports with any individual or organization.
